This paper discusses the 17th-century Latin translation of Proclus’ Commentary on the First Book of Euclid’s Elements, preserved in Madrid, Biblioteca Nacional de España, MS 9871, produced by the Spaniard Vicente Mariner. The author examines the historical context, sources, and motivations behind Mariner’s translation, his intellectual profile, and the potential reasons for translating a mathematical text given his background in literature. Via a comparison of Mariner’s text with the original Greek, this paper delves into Mariner’s translation choices and linguistic (...) nuances to highlight the challenges he faced while translating it. Transcriptions of the collated passage both from Grynaeus’ 1533 editio princeps of Proclus’ text and Mariner’s manuscript are provided in the Appendix. Overall, this paper attempts to shed light on Mariner’s contribution to the Latin reception of Proclus’ work in the early modern period. (shrink)

According to an increasing number of authors, the best, if not the only, argument in favour of physicalism is the so-called 'overdetermination argument'. This argument, if sound, establishes that all the entities that enter into causal interactions with the physical world are physical. One key premise in the overdetermination argument is the principle of the causal closure of the physical world, said to be supported by contemporary physics. Physicalism is the claim that that there is nothing in the world but the physical. Philosophers who defend physicalism have to confront a well-known dilemma, known as Hempel’s dilemma, concerning the definition of ‘the physical’: if ‘the physical’ is whatever current physics says there is, then physicalism is most probably false; but if ‘the physical’ is whatever the true theory of physics would say that there is, we have that physicalism is vacuous and runs the risk of becoming trivial. This (...) article has two parts. The first, negative, part is devoted to developing a criticism of the so-called via negativa response to Hempel’s dilemma. In the second, more substantial, part, I propose to take the first horn of Hempel’s dilemma. However, I argue for a broad construal of ‘current physics’ and characterize ‘the physical’ accordingly. The virtues of the broad characterization of ‘the physical’ are: first, it makes physicalism less likely to be false; and second, it ties our understanding of ‘the physical’ to the reasons we have for believing in physicalism. That is, it fulfills the desideratum of construing our theses according to the reasons we have to believe in them. (shrink)

In this paper we address the question of what determines the content of our conscious episodes of thinking, considering recent claims that phenomenal character individuates thought contents. We present one prominent way for defenders of phenomenal intentionality to develop that view and then examine ‘sensory inner speech views’, which provide an alternative way of accounting for thought-content determinacy. We argue that such views fare well with inner speech thinking but have problems accounting for unsymbolized thinking. Within this dialectic, we present (...) an account of the nature of unsymbolized thinking that accords with and can be seen as a continuation of the activity of inner speech, while offering a way of explaining thought-content determinacy in terms of linguistic structures and representations. There is an ongoing debate about the meaning of lexical words, i.e., words that contribute with content to the meaning of sentences. This debate has coincided with a renewal in the study of polysemy, which has taken place in the psycholinguistics camp mainly. There is already a fruitful interbreeding between two lines of research: the theoretical study of lexical word meaning, on the one hand, and the models of polysemy psycholinguists present, on the other. In this paper I aim at (...) deepening on this ongoing interbreeding, examine what is said about polysemy, particularly in the psycholinguistics literature, and then show how what we seem to know about the representation and storage of polysemous senses affects the models that we have about lexical word meaning. El trabajo consiste en una elucidación de los elementos que conforman el concepto de pena natural (poena naturalis) en el Derecho penal. Se puede caracterizar la pena natural como el daño o sufrimiento que recae sobre el autor de un delito, producto de la comisión del mismo, que debe ser descontado de la pena legal que ha de aplicársele. Si bien existe un mínimo acuerdo sobre esto, tanto en la jurisprudencia como en la doctrina penal se observan serios desacuerdos acerca (...) de los requisitos que se deben cumplir para reconocer que se está frente a una pena natural. Para elucidar los elementos, se utilizará el constructivismo conceptual de Ronald Dworkin, a fin de describir el desacuerdo y sus implicancias, reconocer los elementos principales de la pena natural y justificarlos bajo su mejor luz moral. ABSTRACT This study focuses on the clarification of the conceptual elements of poena naturalis in criminal law settings. The poena naturalis is the damage or suffering that falls on the convict for its commission. This damage must be deducted from the poena forensis to be applied. Although there is a minimum agreement about the concept of poena naturalis, in the jurisprudence and among legal scholars, there are serious disagreements about the elements of poena naturalis. To elucidate the elements, I will adopt Ronald Dworkin’s conceptual constructivism to describe the disagreement and its implications. At last, I will justify the main elements of the poena naturalis by their best moral light. (shrink)

Un especial interés por los problemas vitales del ser humano llevó a Epicuro a distanciarse de las simples teorizaciones y consagrarse a pensar máximas por las que el hombre podría hacerse con las causas y objetos del bienestar. Epicuro asume el cuerpo y la vida sensible como principios de un bienestar que descansa en las afecciones (πάθη), si bien estas son efectos de los estímulos del ambiente que le preceden, además de ser la fuente de las actitudes de aceptación o (...) de rechazo que determinan las acciones humanas. Cierto es que esta perspectiva sensualista describe la εὐδαιμονία como simple satisfacción de deseos y de necesidades cotidianas, pero se hace manifiesto que, en ocasiones, al no coincidir los deseos con el noble interés del bienestar contradicen este fin buscado. Dicho esto, el tema que se expone en el presente texto es la pregunta por los argumentos que validaron el cuerpo y sus sentidos para conocer el mundo y actuar según lo percibido, frente a algunas de las críticas escépticas y plutarqueas. A fundamental tension exists between Rawls's ideal Kantian conception of justice as fairness (JAF), which requires respecting people as ends, and his realistic non-Kantian consequentialist conception of a supreme emergency in a just war. By justifying the targeting of objectively innocent noncombatants during a supreme emergency exception, Rawls allows for treating them as means only. Hence, his appeal to a supreme emergency is insufficient to avoid this tension. First, since for him JAF is ideal but also practical, one might argue (...) that his fictional people in the original position must reflect on the justification for using force on behalf of JAF. And second, since Rawls justifies targeting objectively innocent people during a supreme emergency exemption, he justifies what one might conceive of as emergency terrorism. Emergency terrorism, however, treats people as means only. Therefore, Rawls's Kantian conception of JAF is in tension with his consequentialist justification of a supreme emergency in a just war and hence with emergency terrorism. (shrink)

The renewed interest in concepts and their role in psychological theorizing is partially motivated by Machery’s claim that concepts are so heterogeneous that they have no explanatory role. Against this, pluralism argues that there is multiplicity of different concepts for any given category, while hybridism argues that a concept is constituted by a rich common representation. This article aims to advance the understanding of the hybrid view of concepts. First, we examine the main arguments against hybrid concepts and conclude that, (...) even if not successful, they challenge hybridism to find a robust criterion for concept individuation and to show an explanatory advantage for hybrid concepts. Then we propose such a criterion of individuation, which we will call ‘functional stable coactivation’. En este artículo sostengo que los tres filósofos/pedagogos cubanos del siglo XIX, Félix Varela y Morales, José de la Luz y Caballero y Enrique José Varona, fueron responsables de superar la enseñanza de la escolástica tardía en la Real y Pontificia Universidad de San Jerónimo de La Habana. Contra los filósofos y pedagogos escolásticos tardíos que preferían la lógica silogística y la autoridad de la tradición sobre la inducción, argumentaron a favor de esta última sobre la primera. Puesto que defendían (...) las ideas liberales y republicanas, también argumentaban en contra de aquellos que apelan a la autoridad de la tradición en lugar de a nuestras experiencias cotidianas. Su espíritu liberal desafió no sólo al régimen tiránico impuesto por España, sino a cualquier otro régimen cuya autoridad dependiera de la fuerza más que de la libre voluntad del pueblo a escoger sus gobernantes. According to the thesis of semantic underdetermination, most sentences of a natural language lack a definite semantic interpretation. This thesis supports an argument against the use of natural language as an instrument of thought, based on the premise that cognition requires a semantically precise and compositional instrument. In this paper we examine several ways to construe this argument, as well as possible ways out for the cognitive view of natural language in the introspectivist version defended by Carruthers. Using the method of Descriptive Experience Sampling, some subjects report experiences of thinking that do not involve words or any other symbols [Hurlburt, R. T., and C. L. Heavey. 2006. Exploring Inner Experience. Amsterdam: John Benjamins; Hurlburt, R. T., and S. A. Akhter. 2008. “Unsymbolized Thinking.” Consciousness and Cognition 17 : 1364–1374]. Even though the possibility of this unsymbolized thinking has consequences for the debate on the phenomenological status of cognitive states, the phenomenon is still insufficiently examined. This article deals with the relationship between language and thought, focusing on the question of whether language can be a vehicle of thought, as, for example, Peter Carruthers has claimed. We develop and examine a powerful argument—the "argument from explicitness"—against this cognitive role of language. The premises of the argument are just two: (1) the vehicle of thought has to be explicit, and (2) natural languages are not explicit. We explain what these simple premises mean and why we should believe (...) they are true. La mal llamada “Conquista del Desierto” constituyó una serie de campañas militares ocurridas en el actual territorio patagónico argentino entre los años 1878 y 1885 cuyo resultado fue el asesinato, la violación y sometimiento a la esclavitud de diversos pueblos y comunidades indígenas. Este no fue un caso aislado, sino que se suma a una serie de ataques sistemáticos que han sufrido los indígenas en la Argentina. En los últimos años, a raíz del reclamo y las luchas de los pueblos (...) y comunidades indígenas, así como también de las organizaciones de derechos humanos, se han comenzado a juzgar algunos de estos hechos. En particular, la Masacre de Napalpí (1924) y la Masacre de La Bomba (1947) fueron los primeros que lograron respuestas judiciales favorables. En ambos se determinó que el accionar estatal era constitutivo de un genocidio y, por lo tanto, se debía resarcir a las comunidades actuales. Ahora bien, la Campaña del Desierto, al día de hoy, no tiene respuesta por parte del Estado. Teniendo presente este panorama, nuestro objetivo en este trabajo es reconstruir los diferentes problemas que enfrenta la posibilidad del reclamo judicial. Para ello, comenzaremos describiendo en qué consistió la Campaña del Desierto. Luego, explicaremos la noción de genocidio aplicado a hechos de injusticias históricas. Como tercer paso, reconstruiremos los casos jurisprudenciales que se han preocupado por genocidios indígenas ocurridos en el pasado. Con este panorama revelado, nos enfocaremos en los diferentes problemas jurídicos y políticos que surgen en los reclamos de justicia. (shrink)

This paper is a reaction to the book “Science and the Pursuit of Wisdom”, whose central concern is the philosophy of Nicholas Maxwell. I distinguish and discuss three concerns in Maxwell’s philosophy. The first is his critique of standard empiricism (SE) in the philosophy of science, the second his defense of aim-oriented rationality (AOR), and the third his philosophy of mind. El primero tiene que ver con el concepto de imagen y la interpretación sobre el cine que ya venía siendo una constante —aunque marginalmente— en estas clases de Deleuze. Internal coherence is of great importance for how we think about appreciating objects of aesthetic worth. A disagreement between what we judge to be worthy and what we affectively favor can prevent us from properly grasping its value. However, it is also assumed in the aesthetic domain that our taste changes over time, jeopardising such coherence constraint. These changes can lead to a mismatch between new aesthetic judgments and old aesthetic preferences. This chapter explores a number of issues that emerge (...) from this tension. Using Taylor Swift’s re-recording as a case study, I will explore the relation between fan loyalty and personal authenticity, as well as the role of biographical taste in the reception of these newly recorded albums among Swift’s long-time fanbase. This article explores the norms that govern regular users’ acts of sharing content on social networking sites. Many debates on how to counteract misinformation on Social Networking Sites focus on the epistemic norms of testimony, implicitly assuming that the users’ acts of sharing should fall under the same norms as those for posting original content. I challenge this assumption by proposing a non-epistemic interpretation of (mis) information sharing on social networking sites which I construe as infrastructures for forms of life (...) found online. Misinformation sharing belongs more in the realm of rumour spreading and gossiping rather than in the information-giving language games. However, the norms for sharing cannot be fixed in advance, as these emerge at the interaction between the platforms’ explicit rules, local norms established by user practices, and a meta-norm of sociality. This unpredictability does not leave us with a normative void as an important user responsibility still remains, namely that of making the context of the sharing gesture explicit. If users will clarify how their gestures of sharing are meant to be interpreted by others, they will implicitly assume responsibility for possible misunderstandings based on omissions, and the harms of shared misinformation can be diminished. In the age of web 2.0, the university is constantly challenged to re-adapt its ‘old-fashioned’ pedagogies to the new possibilities opened up by digital technologies. This article proposes a rethinking of the relation between university and (digital) technologies by focusing not on how technologies function in the university, but on their constituting a meta-condition for the existence of the university pedagogy of inquiry. Following Ivan Illich’s idea that textual technologies played a crucial role in the inception of the university, we (...) will first show the structural similarities between university thinking and the text as a profanation of the book. Secondly, we describe university thinking as a type of critical thinking based on the materiality of the text-on-the-page, explaining why the text has been at the centre of university pedagogy since the beginning. In the third part, we show how Illich came to see the end of the culture of the text as a challenge for the university, by describing the new features of the text-as-code incompatible with the idea of reading as study. Finally, we challenge this pessimistic reading of Illich’s and end with a call for a profanatory pedagogy of digital technologies that could mirror the revolutionary thinking behind the mediaeval invention of the text. In this paper I try to show that semantics can explain word-to-world relations and that sentences can have meanings that determine truth-conditions. Critics like Chomsky typically maintain that only speakers denote, i.e., only speakers, by using words in one way or another, represent entities or events in the world. However, according to their view, individual acts of denotations are not explained just by virtue of speakers’ semantic knowledge. Against this view, I will hold that, in the typical cases considered, semantic (...) knowledge can account for the denotational uses of words of individual speakers. (shrink)

Lavinia Marin draws from phenomenology to lay bare another aspect of the ubiquitous presence of social media. By taking the phenomenology of attention as a starting-point, she show that attention is – rather than only a scare resource as analysts departing from the perspective of the attention economy would have it – foundational for our moral relations to other beings. She argues that there is a distinctive form of other-oriented attention that enables us to perceive other beings as living beings (...) that are worthy of care. This mode of attention presupposes a form of affectivity and involves the recognition of the other as a moral being capable of forming judgments, as well as someone having certain vulnerabilities. Her analysis shows that by prioritizing homogenous interactions and standardization, social media platforms hinder us from engaging in this mode of attention, thereby undermining our capacity of recognizing to others as surprising, changing, and fallible beings. The debate concerning prostitution is centered around two main views: the liberal view and the radical feminist view. The typical liberal view is associated with decriminalization and normalization of prostitution; radical feminism stands in favor of prohibition or abolition. Here, I argue that neither of the views is right. My argument does not depend on the plausible (or actual) side effects of prohibition, abolition, or normalization; rather, I am concerned with the ideals involved. I will concede to liberals their claim (...) that prostitution is not harmful in itself. Yet, I will argue that prostitution cannot be thought of as “just another job”. Even if prostitution is not harmful in itself, it can do much harm. I will argue that a policy of vigilance is the most adequate one to adopt with regard of prostitution, given the risk of harm associated with prostitution. A policy of vigilance tries to discriminate between those who take a certain course of action willingly and those who do not. It puts no restraints on those who exercise their genuine will, but protects those who are openly or subtly coerced. (shrink)

This article aims to develop the outline of a possible philosophy of the digital, as a proper philosophy with its own domain, questions, methods and own theories. The article starts by describing the crisis of liniar thinking undersood, following Vilém Flusser, as as a crisis of historical-causal thinking. Then the digital thinking is described as a new way of thinking which aims to become the dominant way of scientific explanation of our times, by replacing historical-causal explanations with numerical models. The (...) proper domain of a philosophy of the digital is then defined as the digital-life form. The article ends by showing an example of a specific problem for the philosophy of the digital, namley the automatisation of human life. (shrink)

There is a dimension of rationality, known as structural rationality, according to which a paradigmatic example of what it means to be rational is not to be akratic. Although some philosophers claim that aesthetics falls within the scope of rationality, a non-akrasia constraint prohibiting certain combinations of attitudes is yet to be developed in this domain. This essay is concerned with the question of whether such a requirement is plausible and, if so, whether it is an actual requirement of aesthetic (...) rationality. Ultimately, this paper defends the view that aesthetics is no different from other domains in that it requires coherence between a subject’s mental states (in the aesthetic case, between what is judged and what is aesthetically liked). We very often discover ourselves engaged in inner speech. It seems that this kind of silent, private, speech fulfils some role in our cognition, most probably related to conscious thinking. Yet, the study of inner speech has been neglected by philosophy and psychology alike for many years. However, things seem to have changed in the last two decades. La doctrina establecida por la Corte Suprema de Justicia de la Argentina en relación a los crímenes de lesa humanidad cometidos durante la última dictadura militar, expresamente declaraba la obligación del Estado de investigar y juzgar a los responsables de su comisión. La Corte no sólo caracterizó dichos delitos, sino que también estableció que no eran susceptibles de amnistía, indulto, ni prescripción. Pero, en el año 2017 dictó el fallo “Muiña” donde, por voto mayoritario, decidió otorgarle el beneficio del “2 (...) por 1” a un condenado por dichos delitos. La consecuencia fue su inmediata libertad por el vencimiento de la condena. La respuesta de la sociedad fue clara. Con diversas manifestaciones, la sociedad civil, las instituciones y las personalidades públicas se declararon en contra de la sentencia. Más aún, del voto de los mismos jueces se observan expresiones que denotan un gran pesar a la hora de tomar la decisión. Más precisamente, sostenían estar ante un dilema. En este trabajo, lejos de realizar un análisis de la interpretación jurídica que se efectuó en la sentencia, se propone trabajar sobre el concepto de dilema y la posibilidad de aplicación en el presente caso. La finalidad concreta es indagar si se está ante un dilema y en su caso si los jueces utilizan este concepto como un arma argumentativa para lograr adhesión o compasión de la opinión pública. En este sentido, se comenzará relatando el marco jurídico del fallo, donde se describirá la historia judicial de Muiña y los argumentos dados por el voto mayoritario y el minoritario de la Corte. Luego, se realizará un análisis del concepto de dilema, para reconstruirlo sobre la base de dos grandes posturas: Una lógica conceptual y otra fenomenológica. Posteriormente, se realizará un examen de la dimensión institucional del derecho y la moralidad judicial, para - finalmente - poder intentar responder si se está efectivamente ante un dilema. Polysemy seems to be a relatively neglected phenomenon within philosophy of language as well as in many quarters in linguistic semantics. Not all variations in a word’s contribution to truth-conditional contents are to be thought as expressions of the phenomenon of polysemy, but it can be argued that many are. Polysemous terms are said to contribute senses or aspects to truth-conditional contents. In this paper, I will make use of the notion of aspect to argue that some apparently wild variations (...) in an utterance’s truth conditions are instead quite systematic. In particular, I will focus on Travis’ much debated green leaves case and explain it in terms of the polysemy of the noun; and in particular, in terms of the as-it-is and the as-it-looks aspects associated with kind words. When Wittgenstein was young, he wrote a small book intended to solve all of philosophy’s problems with language, called Tractatus Logico-Philosophicus (1922). As an intellectual piece, the Tractatus is a strange beast, written by a student with the voice of a professor. Its process of creation resembles that of a fictional piece: the author is struck by inspiration, labours in solitude, and then translates the vision onto paper. Yet the Tractatus was not meant to be a work of fiction, rather (...) to have the final say in a conceptual debate about the relation between language and world. This little book was meant to be the end of all philosophical conversation, the final nail in its coffin. Written outside the university, the Tractatus had the ambition of ending the academic conversation in philosophy, while it refused to engage with that conversation. This was not fair-play on any account. The Tractatus was never intended to be an academic text; it had no footnotes, no references to other authors. It was a vision of language that Wittgenstein had shared with the world. (shrink)

Charles Travis has been forcefully arguing that meaning does not determine truth-conditions for more than two decades now. To this end, he has devised ingenious examples whereby different utterances of the same prima facie non-ambiguous and non-indexical expression type have different truth-conditions depending on the occasion on which they are delivered. However, Travis does not argue that meaning varies with circumstances; only that truth-conditions do. He assumes that meaning is a stable feature of both words and sentences. After surveying some (...) of the explanations that semanticists and pragmaticians have produced in order to account for Travis cases, I propose a view which differs substantially from all of them. I argue that the variability in the truth-conditions that an utterance type can have is due to meaning facts alone. To support my argument, I suggest that we think about the meanings of words (in particular, the meanings of nouns) as rich conceptual structures; so rich that the way in which a property concept applies to an object concept is not determined. In 1915, a student named Walter Benjamin published his first article, entitled “The life of students”. In this reflection on the condition of student life, Benjamin touched upon one of the most puzzling features of the university: its disconnection from the real world. Benjamin draws our attention to the “huge gulf between ideas and life”, which the university was supposed to bridge through its connection with the state. Benjamin claims, however, that there is no such bridge. On the one hand, (...) we have university life, which is all about living and breathing theory, about “the will to submit to a principle, to identify completely with an idea”, as Benjamin puts it. On the other, in the world, we have the unchangeable rites and practices, institutions, marriage, family, jobs, legal systems, and tacit rules of proper behaviour, a way of life to which everyone assents by dedicating their own life to it. Benjamin is saddened that the world remains the same no matter how many students pass through the university, where they engage in an intense theoretical life. An increasingly popular solution to the anti-scientific climate rising on social media platforms has been the appeal to more critical thinking from the user's side. In this paper, we zoom in on the ideal of critical thinking and unpack it in order to see, specifically, whether it can provide enough epistemic agency so that users endowed with it can break free from enclosed communities on social media (so called epistemic bubbles). We criticise some assumptions embedded in the ideal of critical (...) thinking online and, instead, we propose that a better way to understand the virtuous behaviour at hand is as critical engagement, namely a mutual cultivation of critical skills among the members of an epistemic bubble. This mutual cultivation allows members within an epistemic bubble (in contrast, as we will show, with the authority-based models of epistemic echo chambers) to become more autonomous critical thinkers by cultivating self-trust. We use the model of relational autonomy as well as resources from work on epistemic self-trust and epistemic interdependence to develop an explanatory framework, which in turn may ground rules for identifying and creating virtuous epistemic bubbles within the environments of social media platforms. Recently, many philosophers and psychologists have claimed that the explanation that grounds both passivity phenomena in the cognitive domain and passivity phenomena that occur with respect to overt actions is, along broad lines, the same. Furthermore, they claim that the best account we have of such phenomena in both scenarios is the “comparator” account. However, there are reasons to doubt whether the comparator model can be exported from the realm of overt actions to the cognitive domain in general. There is (...) a lingering worry concerning such explanations of thought insertion: the "What is compared to what?" problem. Here I examine two ways to tackle this problem. First: thought insertion consists of the misattribution of strings of inner speech which are not attenuated (thought insertion is thus another name for auditory verbal hallucinations). Second: thought insertion is misattributed inner speech which exhibits the same phenomenological characteristics as normal inner speech. After explaining the types of problem that each of these potential solutions faces, I conclude with a set of open questions that the comparator theorist has to tackle. (shrink)

În studiul Laviniei Marin, Universitatea şi problema proprietăţii intelectuale, este discutată problema actuală a tipului de universitate pe care îl presupune noua economie a cunoaşterii. Pornind de la interesul pentru cuantificarea performanţelor universităţilor şi stabilirea de ierarhii, autoarea ajunge la unele teme epistemologice privind reportul dintre cunoaşterea teoretică şi cunoaşterea practică şi cel dintre cunoaşterea explicită şi cunoaşterea tacită într-o societate în care însăşi cunoaşterea devine un capital, iar inovarea este modul în care se realizează performanţă.

In this article, it is argued that a significant internal tension exists in John Rawls' political liberalism. He holds the following positions that might plausibly be considered incongruous: (1) a commitment to tolerating a broad right of freedom of political speech, including a right of subversive advocacy; (2) a commitment to restricting this broad right if it is intended to incite and likely to bring about imminent violence; and (3) a commitment to curbing this broad right only if there is (...) a constitutional crisis. By supporting a broad right of freedom of political speech in Political Liberalism, he allows militant intolerant people such as Jihadists, White Supremacists and Neo-Nazis to advocate publicly their dangerously intolerant beliefs. Public advocacy of dangerously intolerant beliefs can be construed as subversive advocacy. As demonstrated by the historical examples of the Weimar Republic and the Second Spanish Republic, militant intolerant groups could use a right of subversive advocacy to threaten the stability of liberal democracies. Hence, by allowing them to exercise a broad right of freedom of political speech, Rawls could jeopardize that which he intends to defend, namely the actual political stability of a liberal democratic order. Lastly, Rawls' conception of ideal constitutional interpretation, which privileges a broad right of freedom of political speech, might be insufficient to deal effectively with the threat posed by militant intolerant groups. Yet a tradition of American constitutional interpretation that balances freedom of speech with other important constitutional and/or political values has overcome a civil war, two world wars, the Cold War and the 9/11 terrorist attacks without abandoning democracy or permanently renouncing those values. Still, Rawls' ideal approach to constitutional interpretation might, in hindsight, help us to understand some of the excesses and deficiencies of American jurisprudence in times of emergency.<br><br><br><br>. Sin embargo, las múltiples dificultades sociales hacen de esta el principal foco de problemas, por lo que es necesario incitar a un proceso consciente y perseverante de cambio personal en función del bien común. Así pues, se exponen las principales contribuciones doctrinales de la Iglesia Católica en (...) lo que respecta al problema educativo, con base en los documentos conciliares del Vaticano II, seguidas de una sucinta reflexión que advierte la urgente difusión de valor en beneficio de la humanidad. In Origins of Objectivity, Burge presents three arguments against what he calls ‘deflationism’: the project of explaining the representational function in terms of the notion of biological function. I evaluate these arguments and argue that they are not convincing.

Este artículo estudia la justificación normativa de la adopción de los ensayos clínicos aleatorizados por parte de las autoridades sanitarias británicas como estándar metodológico en 1946. A partir de un análisis de los distintos intereses de los participantes en el proceso (pacientes, médicos, farmacéuticas y el propio Estado) argumentamos que la aleatorización se adoptó como mecanismo de asignación imparcial de tratamientos, aunque sus propiedades estadísticas no fueran bien comprendidas. Tal justificación permanece aún vigente.

This article brings forth a new perspective concerning the relation between stupidity and thinking by proposing to conceptualise the state of non-thinking in two different ways, situated at the opposite ends of the spectrum of thinking. Two conceptualisations of stupidity are discussed, one critical which follows a French line of continental thinkers, and the other one which will be called educational or ascetic, following the work of Agamben. The critical approach is conceptualised in terms of seriality of thinking, or thinking (...) captured by an apparatus, whereas the ascetic-educational approach is discussed by tracing the links between studying and stupidity. Both accounts assume that stupidity as non-thinking is a condition for thinking, either placed before thinking emerges or as an after-thought. However, the political implications concerning the role of philosophy in the public realm are divergent: for the critical approach, the task of the philosopher is to criticise the world, whereas for the ascetic approach, the task is to work on one’s own self and hope that the world will be changed through thinking. The wider aim of this article is to contribute to the debate concerning the public role of the intellectual starting from the assumption that there is a duty to think publicly and then clarifying what this duty entails in relation to the self and the others. This paper explores whether terrorist violence could be morally justified or excused. It defends the absolute immunity of innocent people against those who might want to sacrifice them for other goals. The defense is based on recognizing people’s stringent natural duty of nonmaleficence, which entails an obligation on moral agents to refrain from intentionally bringing about harm or significant risk of it to the innocent. The paper is divided into two parts. The first part distinguishes between unconditional and conditional critics’ (...) arguments regarding the use of terrorist violence, and between a narrow and a broad definition of terrorism. While unconditional critics accept the narrow definition or one akin to it because they equate terrorism with murder, conditional critics accept the broad definition or one akin to it because they attempt to justify or excuse the use of terrorism based, e.g., on an analogy with a just war approach, consequentialism, moral relativism, supreme emergency or last resort. Exception is taken with the latter arguments since they attempt to justify or excuse morally unjustifiable and inexcusable actions such as the deliberate use of violence against the innocent. The second part explores plausible conditional critics’ reasons for justifying or excusing the 9/11/01 attacks and find them wanting. If the argument works, then, with minor modifications, it could also apply to the 3/11/04 attacks in Madrid, the 7/7/05 attacks in London, and similar attacks elsewhere. (shrink)

In this paper, we examine some basic linguistic abilities in a small sample of adults with minimal receptive vocabulary, whose receptive mental verbal age ranges from 1;2 to 3;10. In particular, we examine whether the participants in our study understand noun phrases consisting of a noun modified by an adjective. We use stimuli that they can recognise by name. Except for one participant, we find that, while all of them understand the noun and adjective in isolation, none seems to understand (...) these noun phrases, which means that they seem to not do linguistic composition. In order to test whether the difficulty is linguistic or conceptual, we ran two other studies, one on concept composition, and the other on iconic symbolic composition (composition of pictograms). Results suggest that linguistic composition is particularly difficult in this population, and that vocabulary breadth may not predict compositional abilities. (shrink)

This paper proposes a conceptual framework for evaluating how social networking platforms fare as epistemic environments for human users. I begin by proposing a situated concept of epistemic agency as fundamental for evaluating epistemic environments. Next, I show that algorithmic personalisation of information makes social networking platforms problematic for users’ epistemic agency because these platforms do not allow users to adapt their behaviour sufficiently. Using the tracing principle inspired by the ethics of self-driving cars, I operationalise it here and identify (...) three requirements that automated epistemic environments need to fulfil: (a) the users need to be afforded a range of skilled actions; (b) users need to be sensitive to the possibility to use their skills; (c) the habits built when adapting to the platform should not undermine the user’s pre-existing skills. I then argue that these requirements are almost impossible to fulfil all at the same time on current SN platforms; yet nevertheless, we need to pay attention to these whenever we evaluate an epistemic environment with automatic features. Finally, as an illustration, I show how Twitter, a popular social networking platform, will fare regarding these requirements. (shrink)

This paper proposes three principles for the ethical design of online social environments aiming to minimise the unintended harms caused by users while interacting online, specifically by enhancing the users’ awareness of the moral load of their interactions. Such principles would need to account for the strong mediation of the digital environment and the particular nature of user interactions: disembodied, asynchronous, and ambiguous intent about the target audience. I argue that, by contrast to face to face interactions, additional factors make (...) it more difficult for users to exercise moral sensitivity in an online environment. An ethics for social media user interactions is ultimately an ethics of human relations mediated by a particular environment; hence I look towards an enactive inspired ethics in formulating principles for human interactions online to enhance or at least do not hinder a user’s moral sensitivity. This enactive take on social media ethics supplements classical moral frameworks by asking us to focus on the relations established through the interactions and the environment created by those interactions. In particular, it presents and argues for a cluster decompositionalism, a view that claims that the complexes a token of a word corresponds to on a given occasion are typically built out of a determinate set of basic concepts, most of which are present on most other occasions of use of the word. The first part of the paper discusses some explanatory virtues of decompositionalism in general. Hamas’s deliberate attack on October 7th against innocent civilians is absolutely wrong. Therefore, it should be universally condemned. And yet, I wonder how a universal recognition of an absolute duty of respect for human dignity can help solving the existential conflict confronting Israelis and Palestinians. Ideally, a two-state solution proposed by the international community can be seen as a reasonable and fair compromise. Nevertheless, the reality on the ground is different. Thus far the existence of one state has precluded the (...) existence of another with no end in sight to their mutually destructive violence. Their conflict demands that people who are reasonable and fair-minded try to understand it holistically and to offer an impartial assessment of this intractable conflict without relativizing the undeserved human suffering of all those involved and affected by it. This article proposes a phenomenological interpretation of nostalgia for communism, a collective feeling expressed typically in most Eastern European countries after the official fall of the communist regimes. While nostalgia for communism may seem like a paradoxical feeling, a sort of Stockholm syndrome at a collective level, this article proposes a different angle of interpretation: nostalgia for communism has nothing to do with communism as such, it is not essentially a political statement, nor the signal of a deep value tension (...) between governance and the people. Rather, I propose to understand this collective feeling as the symptom of a deeper need at a national level for solidarity and ultimately about recapturing a common feeling of identity in solidarity. This hypothesis would be in line with a phenomenological approach to memory as a process of establishing shared codes by rewriting the past in such a way as to strengthen social bonds and make possible a reimagining of a common future. Nostalgia for communism does not need to be ultimately an uncritical stance as it has been depicted, instead one could interpret it as a form of critical reflexion about our current forms of life. Instead of seeing communism nostalgia as a specific form of being stuck in the past, one could explore its potential for pointing at the things that are still not working in the current neo-liberal regime.
